Terms of Service & Conditions

Effective Date: 05/06/2025

These Terms of Service ("Terms") govern your use of the services provided by ACH Services ("Company", "we", or "us"), including garage door installations, repairs, maintenance, and related services. By scheduling, approving, or allowing any work to be performed by us, you explicitly agree to the following Terms.

1. General Policy & Cancellations

  • Final Sale: Once a service constitutes completed labor or installed parts, the sale is final.

    • ✅ No refunds, cancellations, or credits will be issued for completed work under any circumstances.

  • Quotes: Any quote provided is valid for 30 days unless stated otherwise. We reserve the right to withdraw or modify a quote prior to acceptance.

2. Deposits and Cancellations

  • ✅ Non-refundable Deposits: All deposits are strictly non-refundable.

  • Liquidated Damages: The customer acknowledges that the deposit covers administrative costs, restocking fees, and reservation of time in our schedule. If the customer cancels the job after the deposit is paid or after materials are ordered, the deposit will be retained by the Company as liquidated damages.

3. Warranties

3.1 Labor Warranty

We provide a limited labor warranty for work performed by our technicians.

  • ✅ The specific labor warranty period for each job is clearly stated on your invoice or work order. Different jobs may have different labor warranty periods, as agreed on site with the technician.

  • If a problem arises strictly due to our workmanship within the written warranty period, we will address it at no additional labor cost.

  • ❗ Note: If the resolution requires additional or different parts that were not originally charged for, the customer is responsible for the cost of those parts.

3.2 Product Warranty (Company Supplied)

Manufacturer warranties apply to new garage doors, openers, and accessories purchased directly through us. We can help facilitate the warranty process, but the terms, coverage, and decisions are dictated by the manufacturer.

3.3 Customer-Supplied Products

When a customer provides their own parts or products (for example, a garage door opener purchased from a retailer):

  • ✅ Our warranty is limited strictly to the installation labor for the period stated on the invoice.

  • ❌ We do not provide any warranty on customer-supplied products themselves. Any failure, defect, or malfunction of the product is the sole responsibility of the customer and the retailer or manufacturer.

3.4 Warranty Exclusions

Our warranty (labor or product) is limited and does not apply in the following situations:

  • ❌ Misuse, neglect, lack of proper maintenance (including failure to lubricate as recommended), or impact damage.

  • ❌ Acts of God such as fire, flooding, wind, storm, or environmental damage including salt and rust.

  • ❌ Power surges, lightning damage, or electrical issues external to the unit.

  • ❌ Damage caused by the failure of a part not replaced by us, or by work, adjustments, or modifications performed by others.

4. Critical: System Condition & Declined Repairs

A garage door system relies on the combined function of springs, cables, drums, rollers, tracks, door sections, and the opener. A weak or damaged part can overload other components.

4.1 "Weak Link" Policy

If we identify worn, damaged, or unsafe parts (for example: rusted springs, frayed cables, bent tracks, cracked door sections) and recommend their replacement, but the customer declines these recommendations:

  • ❌ Any warranty on the new parts or labor we provide is limited or voided if the failure is caused by the old parts you chose not to replace.

  • The Company is not liable for safety issues, additional damage, or system failure resulting from continued use of a compromised system.

4.2 Garage Door Openers on Unbalanced Doors

An electric opener is designed to move a garage door that is properly balanced by the springs. It is not designed to lift a door acting as dead weight. If you purchase a new opener (or we install one) and you decline to replace weak/broken springs or to correct an out-of-balance or binding door:

  • The warranty on the new opener (motor, gears, and drive components) is void if damage or failure is caused by the unbalanced or unsafe door.

  • Operating a motor on a heavy or unbalanced door places excessive strain on the unit and is not considered a manufacturer defect.

4.3 Interaction Between Components

If we replace one part (for example, a spring) and you decline to replace an old or damaged related part (for example, a fraying cable):

  • If that old cable later snaps and causes the new spring to unwind or break, or causes the door to go off-track, we are not responsible for the resulting damage.

  • Any repair of consequential damage in that situation will be treated as a new, billable service call.

5. Customer Responsibilities

  • ✅ Access: Ensure clear access to the garage and work area (move vehicles, debris, snow, ice, stored items). If we cannot safely access the work area, a service call fee may apply.

  • ✅ Presence: Be present (or have an adult representative present) for approval of work and payment, unless otherwise agreed in advance.

  • ❗ Electrical: Provide proper, grounded electrical outlets for openers and equipment. We are not electricians and are not liable for pre-existing electrical issues or code violations.

6. Payments

  • ✅ Full payment is due immediately upon completion of the job, unless otherwise agreed in writing before work begins.

  • ✅ Accepted forms of payment may include cash, check, or credit card, as stated on your invoice or work order.

  • ❌ Dishonored Checks: Any check returned for insufficient funds or any other reason may be subject to a service fee as permitted by Massachusetts law, in addition to any bank fees incurred. Returned checks will not be reprocessed and must be resolved with an alternate form of payment.

  • Right to Lien: In the event of non-payment, ACH Services reserves the right to file a mechanic's lien against the property to recover unpaid balances, in accordance with applicable state law.

7. Returns (Accessories)

  • ❌ Installed Items: No returns or refunds on installed accessories (including keypads, remotes, wall stations, safety sensors, and similar items).

  • ✅ Unopened Items: Unopened accessories may be returned within 30 days with the original receipt, subject to management approval and a possible restocking fee.

8. Safety Standards (UL 325)

  • ❌ We will not repair or reconnect openers manufactured before 1993 that do not have required safety eyes.

  • ✅ We strictly follow UL 325 safety guidelines. Safety sensors must be installed, correctly aligned, and operational. If a system is deemed unsafe, we reserve the right to leave the opener disconnected or out of service until it is brought up to code.

9. Limitation of Liability

To the fullest extent permitted by Massachusetts law:

  • We are not liable for pre-existing structural issues, including uneven floors, rotting wood, misaligned openings, or previously damaged components.

  • We are not liable for incidental or consequential damages, including but not limited to loss of income, delays, or inability to use the garage or driveway.

  • We are not responsible for electrical problems unrelated to our work, including existing wiring, circuit capacity, breakers, or other electrical system issues.

  • Our total liability for any claim related to our services shall not exceed the amount actually paid by the customer for the specific service rendered.

10. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts. Any disputes arising from these Terms or from work performed by ACH Services shall be resolved in the courts located within Massachusetts, subject to applicable law.
